Conditions of Security and Order for Owners of Business Establishments in Conditional Sectors and Occupations

From July 01, 2016, Decree 96/2016/ND-CP stipulating conditions on security and order for conditional business investment sectors and trades will take effect.

The owner of the business establishment who is responsible for the security and order of the business establishment does not fall under the following cases:

- Has been criminally prosecuted;- Has a criminal record for crimes infringing upon national security or other intentional crimes sentenced to 3 years or more without having the record expunged;- Is in the period of suspended execution of imprisonment or non-custodial reform sentence;- Is under surveillance, prohibition of residency, prohibition from assuming positions, or prohibition from business activities;- Is being subjected to local educational measures;- Is under a decision to apply administrative handling measures (BPXLHC) pending execution of the decision;- Is addicted to drugs;- Is under temporary suspension or postponement of the decision to send them to a mandatory educational institution or mandatory rehabilitation center;- Has been subjected to BPXLHC but the period for being considered as not having been subjected to BPXLHC is not yet over;

Decree 96/2016/ND-CP replaces Decree 52/2008/ND-CP and Decree 72/2009/ND-CP.
