Conditions for dismissal of members of the Board of Management in public service units in the field of Agriculture and Rural Development in Vietnam

Specifically, members of the Management Board are dismissed if they fall into one of the following cases:

- There is a written request from the individual to stop participating in the Management Board that is accepted by the competent authority;

- Having limited capacity for civil acts according to a decision of a competent authority;

- Not meeting the requirement on health to undertake the assigned work; have been off work for more than 6 months but the ability to work has not recovered;

- Being convicted by a court of law by a legally effective sentence;

- No longer meets the standards of members of the Management Council as prescribed in Article 10 of Circular 12/2023/TT-BNNPTNT;

- Transferring, retiring, or quitting according to regulations;

- For two consecutive years, the quality of civil servants and public employees has been classified as failing to complete their tasks;

- More than 50% of the total number of members of the Management Council make a written request for dismissal;

- There are other violations specified in the regulations on the organization and operation of public service units and the operating regulations of the Management Council.

The authority competent to appoint the Chairman of the Council and members of the Management Council shall consider and decide to dismiss the Chairman of the Council and members of the Management Council.

It is known that the Management Council has from 5 to 11 members, depending on the characteristics of the unit, including the Chairman, Secretary, and other members. Depending on task requirements, the Management Council may have a Vice Chairman of the Council.

The Chairman and other members of the Management Council are appointed by the head of the agency competent to approve the autonomy project of the public service unit. The term of office of a member of the Management Board shall not exceed 05 years.
