On May 15, 2021, the Ministry of Public Security of Vietnam issued Circular 54/2021/TT-BCA regulating international treaties and international agreement in the People's Public Security.
According to Vietnam's circular, simplified procedures apply to the conclusion of a treaty in case the following conditions are satisfied:
- The reduced procedures only apply to negotiation, conclusion, amendment and extension of the treaties in Vietnam;
- Except the following cases:
+ Simplified processes and procedures for negotiation, signature, amendment, supplementation and extension of a treaty under the authority to ratify, decide to accede to or terminate treaties of the National Assembly shall not be applied.
+ Simplified processes and procedures for negotiation, signature, amendment, supplementation and extension of a treaty on foreign borrowing in the name of the Government of Vietnam shall be implemented as provided in laws and regulations on public debt management.
Pursuant to the above provisions, the unit proposing the conclusion of a treaty shall report to the Minister on the negotiation, signing, amendment, supplementation, and extension of the treaty according to the order and procedures for shortening the regulations set out in Chapter VII of Vietnam's Law on International Treaties 2016
Vietnam's Circular 54/2021/TT-BCA takes effect from July 1, 2021.
