The President issued 766/2022/QD-CTN on July 1, 2022 on amnesty in Vietnam.
According to the Decision in Vietnam, conditions for amnesty for persons under 18 years old who are serving prison sentences include:
- Have made considerable progress in and had a growing awareness of rehabilitation, and have been ranked as good or excellent while serving his/her imprisonment sentence as prescribed in law on criminal judgment enforcement in Vietnam.
- Not fall into the cases that are not eligible for amnesty in Article 4 of Decision 766/2022/QD-CTN.
- Having served his/her imprisonment sentence for at least one-third or two-fifths of his/her imprisonment term for cases of being sentenced to prison for one of the crimes at Point b, Clause 1, Article 3 of Decision 766/2022/ QD-CTN.
In addition, for persons under 18 years of age who are suspended from serving prison sentences, amnesty conditions include:
- Have made considerable progress in and had a growing awareness of rehabilitation, and have been ranked as good or excellent while serving his/her imprisonment sentence as prescribed in law on criminal judgment enforcement before the issuance of the suspense decision.
- Strictly abide by the law during the suspension of serving prison sentences.
- Do not fall into the cases that are not eligible for amnesty in Article 4 of Decision 766/2022/QD-CTN.
- Having served at least one-third of the time or at least two-fifths of his/her imprisonment term for the case of being sentenced to prison for one of the crimes at Point b, Clause 1, Article 3 of Decision 766/2022/ QD-CTN in Vietnam
