On September 17, 2024, the Office of the Government of Vietnam issued Notification 421/TB-VPCP regarding the Conclusion of Deputy Prime Minister Tran Hong Ha at the meeting on the draft Decree amending Decree 08/2022/ND-CP guiding the Law on Environmental Protection 2020.
After listening to the report from the Ministry of Natural Resources and Environment of Vietnam, the opinions of the delegates attending the meeting, Deputy Prime Minister of the Government of Vietnam Tran Hong Ha requested the completion of the following contents:
- The Ministry of Natural Resources and Environment of Vietnam continues to focus on reviewing all administrative procedures stipulated in Decree 08/2022/ND-CP to ensure strict implementation of the Prime Minister of the Government of Vietnam's directive in Official Dispatch 391/TTg-NN dated June 10, 2024. Accordingly, implement decentralization, delegation of authority, resource allocation, avoiding the requesting mechanism, facilitating localities and businesses, ensuring the set goals of cutting administrative procedures when drafting the Decree.
- Regarding the regulation on export tax exemption for products produced from recycling and waste treatment activities and effective from January 10, 2022; regulations on machinery, equipment, vehicles, specialized tools, materials imported for use in projects and facilities implementing services of collection, transportation, and centralized treatment of domestic solid waste and centralized domestic wastewater treatment services being exempt from import tax.
- Regarding the regulations on the roadmap and the proportion of imported scrap from abroad as production materials.
- Regarding the recycling cost norm (Fs).
- Assign the Ministry of Natural Resources and Environment of Vietnam to research and incorporate the opinions of the Ministry of Planning and Investment at the meeting on the addition of regulations about preliminary assessments of environmental impacts (responsibility, scope, content, and timing for opinions).
- Regarding the financial responsibilities of enterprises in the collection and treatment of discarded products, the Ministry of Natural Resources and Environment of Vietnam should study the opinions of the Ministry of Industry and Trade raised at the meeting to find solutions based on the principle of thoroughly assessing the impacts of this plan.
- The Ministry of Natural Resources and Environment of Vietnam should continue to carefully review the Appendices attached to the draft Decree to ensure the criteria and contents in the Appendices are quantitative, scientifically based, and feasible. Continue to study the opinions of Members of the Government of Vietnam to incorporate and complete the draft Decree; report to the Prime Minister of the Government of Vietnam before September 20, 2024.
