Clarification on the Implementation of Judicial Measures for Minors

The Supreme People's Court has just issued Official Dispatch 90/TANDTC-PC addressing difficulties regarding the implementation of judicial measures for placing minors into reformatory schools.

Accordingly:

- The court is not required to issue a Decision to enforce judicial measures to place minors in reformatory schools;- Within 03 working days from the date of issuing the judgment, the decision to apply judicial measures, the court shall send the judgment, decision to that person and to the Criminal Judgment Enforcement Agency (THAHS) of the district-level police where that person resides for this agency to report to the Ministry of Public Security's THAHS Agency;- The Ministry of Public Security's THAHS Agency shall issue a decision to place the minor in a reformatory school.

The Chief Justice of the People's Court and the military courts at all levels, heads of units under the Supreme People's Court, are responsible for strictly implementing the above regulations, ensuring that the enforcement of judicial measures to place minors in reformatory schools is carried out in accordance with the law.
