Circular guiding the Housing Law 2023 issued by the Minister of Construction of Vietnam

Circular 05/2024/TT-BXD provides detailed regulations on certain provisions of the Housing Law 2023, including:

- Point a, Clause 2, Article 21 about the written notification regarding the lease of houses owned by foreign individuals in Vietnam to the district-level housing management agencies (hereinafter referred to as district-level housing management agencies) where the house is located.

- Point a, Clause 3, Article 57 on the requirements for building multi-story and multi-apartment houses by individuals.

- Clause 5, Article 57 on the Regulations on management and use of condominiums.

- Clause 9, Article 78 on the forms of documents evidencing the subjects specified in Clauses 1, 2, 3, 4, 5, 6, 8, 9, 10, and 11, Article 76 of the Housing Law 2023; forms of documents evidencing the conditions to enjoy social housing support policies.

- Clause 3, Article 191 on the budget for building provincial-level housing development programs and plans.

- Clause 4, Article 191 on the forms of contracts for the sale, lease-purchase, lease of social housing, resettlement housing, and public property housing.

- Clause 14, Article 191 on the framework program for training and fostering expertise in condominium management and operation.

Circular 05/2024/TT-BXD applies to:

- Domestic organizations and individuals, overseas Vietnamese, foreign organizations and individuals related to the contents regulated in Circular 05/2024/TT-BXD.

- State management agencies related to the contents regulated in Circular 05/2024/TT-BXD.

Regulations on sample housing contracts in Vietnam

- The sample for the sale contract of resettlement housing is specified in Appendix III issued with Circular 05/2024/TT-BXD.

- The sample for the lease-purchase contract of resettlement housing is specified in Appendix IV issued with Circular 05/2024/TT-BXD.

- The sample for the lease contract of resettlement housing and old public property housing is specified in Appendix V issued with Circular 05/2024/TT-BXD.

- The sample for the sale contract of social housing is specified in Form No. 01 of Appendix VI issued with Circular 05/2024/TT-BXD; the sample for the lease-purchase contract of social housing is specified in Form No. 02 of Appendix VI issued with Circular 05/2024/TT-BXD; the sample for the lease contract of social housing is specified in Form No. 03 of Appendix VI issued with Circular 05/2024/TT-BXD.

- The sample for the sale contract of old public property housing is specified in Appendix VII issued with Circular 05/2024/TT-BXD.

Circular 05/2024/TT-BXD takes effect in Vietnam from August 1, 2024.
