The Ministry of Finance issues Circular 37/2018/TT-BTC providing guidance on certain contents regarding the reorganization and handling of houses and land as stipulated in Decree 167/2017/ND-CP.
Translation:
Agencies, organizations, units, businesses directly managing and utilizing the houses and lands are to declare, report, and propose a plan for reorganization and handling of houses and lands according to Form No. 01 (attached Decree 167) and should pay attention to the following content columns:
- “Land Area” (Column 3): Record the total area of the land campus in m^2^ currently being managed and used according to the legal documentation on the land.
If there is a discrepancy between the legal documentation and the actual number, record the actual number being used and state the reason for the discrepancy.- “House Area” (Column 4): The total land area occupied by houses (for 01-floor houses). If the house has ≥ 02 floors, then the “House Area” is divided into: “House Construction Area” (Column 4a) and "House Usable Floor Area" (Column 4b).- “Legal Documents” (Column 5) include: Land allocation decision, land lease decision, Land Use Rights Certificate, land lease contract, house lease contract, etc. If there are no documents, specify clearly as “none” or “lost”.
Circular 37/2018/TT-BTC is effective from June 1, 2018.
