Circular 04/2020/TT-BTP: Regulations on the Value of the Certificate of Marital Status

The Ministry of Justice has just issued Circular 04/2020/TT-BTP detailing the implementation of certain provisions of the Civil Status Law and Decree 123/2015/ND-CP.

Circular 04/2020/TT-BTP stipulates that the Certificate of Marital Status is valid until the time of change in marital status or 6 months from the date of issuance, whichever comes first.

Example: A Certificate of Marital Status issued on February 3, 2020, but if the individual issued with the Certificate of Marital Status registered for marriage on February 10, 2020, then the Certificate of Marital Status would only be valid for use until February 10, 2020.

Currently, Decree 123/2015/ND-CP only stipulates that the Certificate of Marital Status is valid for 6 months from the date of issuance.

In addition, Circular 04/2020/TT-BTP also stipulates that in cases where a Certificate of Marital Status is requested for the purpose of marriage, the civil registration authority shall issue only one copy to the requester. The Certificate of Marital Status must clearly state the full name, year of birth, nationality, identification documents of the intended spouse, and the intended place of marriage registration.
