Changes to application for mineral extraction right bidding in Vietnam

Decree No. 22/2023/ND-CP has amended Points b, c, and d Clause 2 Article 16 of Decree No. 22/2012/ND-CP (amended by Decree No. 158/2016/ND-CP) on application for mineral extraction right bidding in Vietnam as follows:

- Originals or certified copies or copies enclosed with the originals for comparison or certified electronic copies of:   

+ Written introduction of the bidder’s capability and experience in mineral exploration, extraction and processing;

+ Written introduction of the bidder’s financial situation and fund raising capability.

(Previously according to Point b Clause 2 Article 16 of Decree No. 22/2012/ND-CP (amended by Decree No. 158/2016/ND-CP), business registration certificates and enterprises registration certificates were required.)

-  For an area with mineral exploration results, bidders shall prepare originals or digitally signed electronic copies of a preliminary investment program on mineral extraction, in-depth processing, product sale, and an implementation commitment if they win the auction.

(Previously, according to Point c Clause 2 Article 16 of Decree No. 22/2012/ND-CP, originals of the program and commitment mentioned above were required.)

- For an area without mineral exploration results, bidders shall prepare originals or digitally signed electronic copies of a preliminary investment plan for mineral extraction, in-depth processing, product sale, and an implementation commitment if they win the auction.

 (Previously, according to Point d Clause 2 Article 16 of Decree No. 22/2012/ND-CP, originals of the plan and commitment mentioned above were required.)
