Cases where party members unjustly disciplined do not receive an apology in Vietnam

The cases where party members are unjustly disciplined and are not apologized to or have their rights restored is a notable content in Regulation 117-QD/TW issued in 2023, concerning the apology and restoration of rights for party organizations and members who have been unjustly disciplined in Vietnam.

Cases where party members unjustly disciplined do not receive an apology in Vietnam

Party members unjustly disciplined in Vietnam are not apologized to and reinstated in the following cases:

- After being unjustly disciplined, they have not maintained the qualities, standards of party members, or have violated and been disciplined.

- Accepting fault on behalf of others leading to wrongful discipline.

- Refusing the apology and reinstatement.

- Voluntarily leaving party activities.

- Not fulfilling or improperly fulfilling the rights and responsibilities of party members as stipulated in Article 8 of Regulation 117-QD/TW of 2023.

Procedures for Organizing Apologies and Reinstating Rights for unjustly disciplined Party Members in Vietnam

- Immediately after issuing a conclusion and decision determining wrongful discipline, the party organization must send written documents to the relevant organizations and individuals as prescribed.

- Within 30 days from the date of receiving the conclusion and decision from the competent authority, the unjustly disciplined organization or party member must send a written request for an apology and reinstatement of rights to the party organization that made the wrongful discipline decision.

- Within 60 days from the date of receiving the conclusion and decision on wrongful discipline, the party organization that made the wrongful discipline decision is responsible for:

+ Notifying in writing the party organization, unjustly disciplined party members (or their relatives) about the organization of the apology and reinstatement of rights.

+ Revoking and annulling the wrongful discipline decision; simultaneously sending to the agency or organization where the party member is working or participating to revoke or annul the administrative or collective discipline decision against the party member (if any).

+ Reinstating rights or recommending the competent authority to reinstate the rights of the unjustly disciplined organization or party member.

- Within 30 days from the date of receiving the request from the party organization that made the wrongful discipline decision, the competent authority shall implement the reinstatement of the rights of the organization and party member as prescribed.
