On September 18, 2023, the Prime Minister of Vietnam issued Decision 23/2023/QD-TTg on the establishment, organization and operation of inter-sectoral coordination organizations.

Cases of establishing inter-sectoral coordination organizations from December 10, 2023 in Vietnam

Specifically, an inter-sectoral coordination organization under the Prime Minister's decision-making authority will be established in the following cases:

- When solving important tasks related to national defense, security, foreign affairs, mobilizing large resources, and key national projects, work related to state management tasks in many ministries and ministerial-level agencies requires centralized direction and administration from the Prime Minister.

- When a particularly serious disaster, incident, natural disaster, or epidemic occurs that is beyond the ability of a single ministry or ministerial-level agency to handle, it is necessary to focus on resolving it within a certain period of time.

(Compared to the current Decision 34/2007/QD-TTg, this new regulation eliminates the case of establishing an inter-sectoral coordination organization according to the provisions of laws, resolutions of the National Assembly, ordinances, resolutions of the National Assembly Standing Committee, decisions of the President, resolutions, and decrees of the Government)

Regulations on appraisal of establishment of inter-sectoral coordination organizations in Vietnam

According to Article 9 of Decision 23/2023/QD-TTg, the appraisal of establishing an inter-sectoral coordination organization is regulated as follows:

(1) The Ministry of Home Affairs is responsible for appraising the establishment of an inter-sectoral coordination organization within 01 to 03 working days from receipt of complete documents as prescribed in (2).

(2) Ministries and ministerial-level agencies that propose to establish an inter-sectoral coordination organization send dossiers to the Ministry of Home Affairs for appraisal. Documents submitted for appraisal include:

- Proposal on the establishment of an inter-sectoral coordination organization, clearly stating the necessity, functions, tasks, powers, expected composition, standing agencies, and duration of operation of the inter-sectoral coordination organization;

- Draft Establishment Decision;

- Draft regulations on organization and operation that clearly state the principles of organization and operation, the working regime and working relationships, the responsibilities of heads and members of inter-sectoral coordination organizations, the tasks of standing agencies, and the information and reporting regime;

- Written opinions of relevant agencies and organizations;

- Report on receiving and explaining the opinions of relevant agencies and organizations.

Decision 23/2023/QD-TTg takes effect on December 10, 2023, and replaces Decision 34/2007/QD-TTg dated March 12, 2007.
