C/O RCEP form for export to be applied from 2023 according to Circular 32/2022/TT-BCT in Vietnam

The Minister of Industry and Trade of Vietnam issued Circular 32/2022/TT-BCT dated 18/11/2022, amending Circular 05/2022/TT-BCTon the Rules of Origin in the RCEP Agreement.

According to Vietnam's Circular 32/2022/TT-BCT, Appendix III on the C/O form and RCEP form of the export and the form of the C/O supplemental declaration at point c, clause 1, of Article 4 of Vietnam's Circular 05/2022/TT-BCT shall be replaced with Appendix II to Vietnam's Circular 32/2022/TT-BCT.

The new C/O form (RCEP export form) and the new C/O supplemental declaration form will apply from the effective date of Vietnam's Circular 32/2022/TT-BCT (January 1, 2023).

In addition, Appendix I on specific rules at Point a, Clause 1, Article 4 of Circular 05/2022/TT-BCT will be replaced with Appendix I attached to Vietnam's Circular 32/2022/TT-BCT.

This appendix is built on the Harmonized System of Commodities Description and Code 2022 (HS Version 2022).

Vietnam's Circular 32/2022/TT-BCT takes effect on January 1, 2023.
