On May 23, 2024, the Central Executive Committee of Vietnam issued Regulation 148-QD/TW regarding the authority of the head in temporarily suspending subordinates from work in necessary cases or when there are signs of serious violations of Vietnam Communist Party regulations and State laws.
The basis for the temporary suspension of subordinate officials in Vietnam is stipulated as follows:
(1) In necessary cases
- The official has engaged in behavior violating moral qualities and lifestyle, causing negative impacts and public outrage, and adversely affecting the reputation of the organization or individual.
- The official has deliberately delayed, shifted, or evaded responsibility, and has not performed tasks within their jurisdiction according to assigned functions and duties.
- The official has committed acts of corruption, negativity, and harassment affecting citizens, businesses, agencies, and organizations during the execution of official duties.
- The official is under review and disciplinary action but intentionally delays or avoids fulfilling the requirements of the competent authority during the review and handling of their violations or exploits their position, power, or influence of others to obstruct the review and handling process.
- The official has been disciplined by the party with a warning or dismissal and is awaiting consideration and handling of their governmental position, where continued work would negatively affect the activities of the party committee, party organization, agency, or unit.
(2) In cases of serious violation signs
- The official has been prosecuted to serve the investigation process.
- During the review and handling of the official’s violations, there is a basis to determine that disciplinary action from a warning upwards or legal actions needs to be taken, and the inspection, audit, investigation, prosecution, trial, and judgment enforcement agencies have issued a written request for the temporary suspension of the official.
