On December 30, 2023, the Minister of Health of Vietnam issued Circular 31/2023/TT-BYT regulating the authority to revoke the Certificate of Food Safety under the management of the Ministry of Health.

The issuing agency of the certificate of food safety has the authority to revoke the issued certificate.

The basis for revoking the certificate of food safety is as follows:

- The competent agency has the authority to revoke the certificate of food safety when conducting inspections, examinations, or at the request of the inspection agency, as specified in the form 01 issued together with Circular 31/2023/TT-BYT, when discovering that the establishment does not meet the following conditions:

+ Failing to meet the food safety requirements for production, processing, and trading of food according to the provisions in Articles 19, 20, 21, 22, 25, 26, 27, 28, 29, and 30 of the Law on Food Safety;

Specific regulations are stated in Clause 2, Article 2 of Decree 155/2018/ND-CP amending and supplementing some regulations related to investment and business conditions within the state management scope of the Ministry of Health; Article 28 of Decree 155/2018/ND-CP detailing the implementation of certain provisions of the Law on Food Safety and other relevant legal regulations;

+ Not having the registered food business profession in the Certificate of Business Registration/Certificate of Enterprise Registration.

- Within 5 working days from the date of receiving the request document to revoke the certificate of food safety by the inspecting agency, the competent authority must issue a Decision to revoke the certificate of food safety of the establishment, according to Form 02 issued together with Circular 31/2023/TT-BYT.
