Arrangement of Resettlement Housing When Apartment Buildings Are Demolished

According to Circular 21/2016/TT-BXD guiding the implementation of Decree 101/2015/ND-CP on the renovation and reconstruction of apartment buildings, the signing of contracts for leasing, lease purchase, and sales of housing for resettlement arrangements when the apartment buildings are demolished is as follows:

- Condominium owners who do not require on-site resettlement:- For existing housing, follow the regulations in Decree 99/2015/ND-CP;- For future housing, follow the regulations in Decree 76/2015/ND-CP.

- Condominium owners who require on-site resettlement:- In the case of compensation with housing and arrangement for on-site resettlement, the condominium owners shall sign a contract with the investor or the unit assigned to arrange the resettlement;- In the case of resettlement arrangement in the form of rental housing, it shall follow the regulations in Decree No. 99/2015/ND-CP and Circular 19/2016/TT-BXD;- In cases where the resettled person is entitled to purchase an additional apartment as per Clause 3, Article 4 of Decree 101/2015/ND-CP, follow the regulations in Decree 76/2015/ND-CP.

Circular 21/2016/TT-BXD is effective from August 15, 2016.
