Procedures and Steps for Approval of Local Adjustment of HCMC Urban Planning

According to the pilot decentralization regulation, stipulated in Article 39 of the Law on Construction, amended and supplemented in Clause 12 Article 28 of the Law Amending and Supplementing a Number of Articles of 37 Laws Related to Planning 2018 and Article 51 of the Law on Urban Planning 2009 amended and supplemented in Clause 10 Article 29 of the Law Amending and Supplementing a Number of Articles of 37 Laws Related to Planning 2018 (Law No. 35/2018/QH14), the People's Committee of Ho Chi Minh City directs the implementation of the following steps:

- Prepare a report on the content and plan for local adjustment of urban planning.

- Organize the collection of opinions on the content of the local adjustment of urban planning.

- Conduct the appraisal of the local adjustment of urban planning.

- Approve the local adjustment of urban planning after obtaining written agreement from the Ministry of Construction.

- Update and publish the content of the local adjustment of urban planning as stipulated.

- Report the results of the implementation of local adjustment of urban planning in the form of sending the Decision on approval of the local adjustment of urban planning to report to the Prime Minister of the Government of Vietnam, the Ministry of Construction, and the People's Council at the same level.

Pilot decentralization to the People's Committee of Ho Chi Minh City to approve local adjustments of general construction planning for functional areas, local adjustments of urban general planning, and local adjustments of specialized technical infrastructure planning (hereinafter referred to as local adjustment of planning) within the administrative boundaries under its management based on the planning projects approved by the Prime Minister of the Government of Vietnam.

More details can be found in Decision 20/2023/QD-TTg effective from the date of signing and ceases to be effective when Resolution 98/2023/QH15 ceases to be effective.
