Appraisal and acceptance of the administrative boundary records in Vietnam as prescribed from October 18, 2024

On October 18, 2024, the Minister of Home Affairs issued Circular 11/2024/TT-BNV regarding the establishment and management of administrative boundary records, which includes regulations on the components of the administrative boundary records in Vietnam.

Appraisal and acceptance of the administrative boundary records in Vietnam as prescribed from October 18, 2024

Article 4 of Circular 11/2024/TT-BNV provides guidelines for the appraisal and acceptance of the administrative boundary records in Vietnam as prescribed from October 18, 2024 as follows:

(1) Inspecting and Reviewing the administrative boundary record

- The Provincial People's Committee shall send a document requesting the Ministry of Natural Resources and Environment to inspect and review the dossier on local administrative unit boundaries in accordance with the law on technical determination of administrative unit boundaries, marking administrative unit boundaries, and compiling the administrative boundary record at all levels.

- Based on the inspection and review results provided by the Ministry of Natural Resources and Environment, the Provincial People's Committee shall complete the dossier and submit it to the Ministry of Home Affairs of Vietnam for appraisal and acceptance.

(2) Documents Required for Appraisal and Acceptance Include:

- A request document from the Provincial People's Committee.

- A report on the results of compiling the administrative boundary record.

- The administrative boundary record at all levels in paper form (single copy) and in digital form.

- A copy of the Approval Decision accompanied by the technical-design estimate for compiling the administrative boundary record.

- Copies of the inspection and acceptance dossier by the Provincial People's Committee, the investor supervisory level, and the construction unit (if any).

- Copies of the minutes and documents determining the administrative unit boundary in the field.

- A document from the Ministry of Natural Resources and Environment of Vietnam regarding the results of the technical inspection and review in determining and marking administrative unit boundaries, and compiling the administrative boundary record at all levels.

- The results of updating the national boundary on the dossier of administrative unit boundaries (if any).

(3) The Appraisal Council for the administrative boundary record Comprises Representatives from the Ministries: Home Affairs, Natural Resources and Environment, National Defense, Foreign Affairs.

(4) Content of the Appraisal

- The procedure and results of compiling the administrative boundary record.

- The legal value of the various documents and administrative boundary records.

- The authority and responsibility of relevant agencies, organizations, and individuals in managing and compiling the administrative boundary records.

(5) Acceptance of the Quantity and Quality of the administrative boundary record

Based on the voting results of the Appraisal Council, the Minister of Home Affairs of Vietnam shall review and decide on the acceptance of the quantity and quality of the administrative boundary record at various local levels.
