On September 18, 2023, the Government of Vietnam promulgated Decree No. 70/2023/ND-CP on amendments to Decree No. 152/2020/ND-CP on foreign workers in Vietnam and recruitment and management of Vietnamese workers working for foreign organizations or individuals in Vietnam.
According to the Circular, an application for re-issuance of the work permit to a foreign worker is as follows
(1) A written document requesting the re-issuance of the work permit of the employer according to Form No. 11/PLI of Appendix I promulgated together with Decree No. 152/2020/ND-CP.
(2) 2 color photos (sized 4 cm x 6 cm, white background, straight face, bare head, and no colored glasses), photos shall be taken within 6 months prior to the submission date.
(3) The unexpired work permit:
- In case the work permit is lost according to Clause 1 Article 12 of Decree No. 152/2020/ND-CP, there must be a confirmation of a public security authority of the commune where the foreigner resides or a foreign competent authority according to laws;
- In case of changes to the content displayed on the work permit, there must be documents proving such changes.
(4) Documents prescribed in (3) must be the original or certified copies, except for cases prescribed in Clause 1 Article 12 of Decree No. 152/2020/ND-CP. In case of foreign documents, they must be subject to consular legalization, translated into Vietnamese, and authenticated or certified in case of exemption from consular legalization according to international treaties to which the Socialist Republic of Vietnam and the concerned foreign country are signatories or according to the reciprocity principle or laws.
(Compared to the previous regulation, according to Decree No. 70/2023/ND-CP, an acceptance of demand for foreign workers (unless it is not required) is no longer required)
Decree No. 70/2023/ND-CP comes into force as of its date of signing.
