Application of request for change of location of head office of a credit institution being a cooperative in Vietnam

Governor of the State Bank of Vietnam issued Circular 22/2022/TT-NHNN dated 30/12/2022 amending Circular 05/2018/TT-NHNN regulations on dossiers, order and procedures for accepting changes, list of expected election and addition of personnel of credit institutions being cooperatives.

According to Vietnam's Circular 22/2022/TT-NHNN, the composition of the application to change the location of the head office of a credit institution that is a cooperative, applied from March 1, 2023, is as follows:

- A written request for approval to relocate the head office, made in accordance with the form in Appendix 02, issued in conjunction with Circular 22/2022/TT-NHNN;

(Currently in Vietnam's Circular 05/2018/TT-NHNN, the written request for approval to change the charter capital does not have a specific form, but only lists the minimum required contents)

- Resolution of the General Meeting of Members approving the relocation of the headquarters;

(In Vietnam's Circular 05/2018/TT-NHNN, the document approving the change of the head office location of the General Meeting of Members is shown in the form of a decision)

- Documents and documents proving that, as a cooperative, the credit institution has the legal right to use or own the head office at the new location.

Vietnam's Circular 22/2022/TT-NHNN takes effect from March 1, 2023.
