Application and procedures for establishing associations in Vietnam from November 26, 2024

The dossier and procedures for establishing associations in Vietnam are as follows:

- The application for establishment of associations in Vietnam is prepared in 01 set, including:

+ An application for the establishment of associations in Vietnam according to the template attached to Decree 126/2024/ND-CP (original);

+ Draft charter according to the template attached to Decree 126/2024/ND-CP;

+ Decision on recognizing the mobilization committee for the establishment of the association, attached with the list of members of the mobilization committee for the establishment of the association (original);

+ List and registration forms of organizations and Vietnamese citizens registering to participate in the establishment of the association (original);

+ Personal resume according to the template attached to Decree 126/2024/ND-CP and judicial record number 1 (original) of the head of the mobilization committee for the establishment of the association not exceeding 06 months as of the date of dossier submission;

+ Consent of the competent authority as prescribed on decentralization of management of officials regarding officials and public employees participating as the head of the mobilization committee for establishing the association (original);

+ Documents proving the legal right to use the place proposed as the headquarters of the association according to legal regulations (original or certified copy);

+ Declaration of assets for establishing the association (original) of the mobilization committee voluntarily contributed (if any);

+ Commitment to ensure operating funds during the first term of the association if established (original).

- Within 60 working days from the date of receiving a complete and legal dossier as prescribed in Clause 1, Article 13 of Decree 126/2024/ND-CP, the competent state agency stipulated in Clauses 2, 3, and 4, Article 15 of Decree 126/2024/ND-CP shall cooperate with relevant agencies regarding the activities of the association to decide on the grant of permission to establish the association; in cases where permission is not granted, a written response with clear reasons must be provided.

Decree 126/2024/ND-CP takes effect in Vietnam from November 26, 2024, replacing Decree 45/2010/ND-CP and Decree 33/2012/ND-CP.
