Announcement of 10 administrative procedures to be amended or supplemented in the employment sector in Vietnam from March 29, 2024

On March 29, 2024, the Minister of Labor, Invalids, and Social Affairs issued Decision 351/QD-BLDTBXH to announce administrative procedures to be amended or supplemented in the employment sector within the state management scope of the Ministry of Labor, Invalids, and Social Affairs.

Accordingly, Decision 351/QD-BLDTBXH announced 10 revised or amended administrative procedures in the employment sector within the state management scope of the Ministry of Labor, Invalids, and Social Affairs, including:

  • Procedures for participation in unemployment insurance;

  • Procedures for resolving unemployment benefits;

  • Procedures for suspending unemployment benefits;

  • Procedures for resuming unemployment benefits;

  • Procedures for terminating unemployment benefits;

  • Procedures for transferring the payment location of unemployment benefits (transferring out);

  • Procedures for transferring the payment location of unemployment benefits (transferring in);

  • Procedures for resolving vocational training support;

  • Procedures for job counseling and introduction support;

  • Procedures for monthly reporting on job searching.

Procedures for participation in unemployment insurance in Vietnam from March 29, 2024

  • Step 1: Within 30 days from the effective date of the labor contract or work contract, the employer shall prepare and submit the unemployment insurance participation dossier for the employees to the social insurance agency.

  • Step 2: Monthly, the employer shall contribute unemployment insurance at a rate of 1% of the monthly salary fund of employees participating in unemployment insurance and deduct 1% of each employee’s monthly salary to contribute simultaneously to the unemployment insurance fund.

Accordingly, the employer shall prepare and submit the unemployment insurance participation dossier and contribute unemployment insurance at the stipulated rate for the employees to the social insurance agency.
