Amendments to regulations on the contents of plans for forest allocation, lease or repurposing in Vietnam

On July 18, 2024, the Government of Vietnam issued Decree 91/2024/ND-CP amending Decree 156/2018/ND-CP, which provides guidance on the 2017 Law on Forestry.

Amendments to regulations on the contents of plans for forest allocation, lease or repurposing in Vietnam

The content of the Plans for forest allocation, lease or repurposing in Vietnam is as follows:

- The area of various types of forests in the district, detailed to each commune, including: total forest area; allocated forest area, leased forest area; unallocated forest area, unleased forest area; results of forest use conversion for other purposes from the start of the planning period to the time of plan formulation according to the template;

- The forest allocation plan, forest leasing plan in the district detailed to each commune, identifying sub-compartment, parcel, plot, forest area, forest type, allocated forest area, leased forest area according to the template;

- The plan for converting forest use for other purposes in the district detailed to each commune, specifically identifying the project name, project implementation location, position (sub-compartment, parcel, plot), forest area, forest origin (natural forest, planted forest), forest type (special-use forest, protection forest, production forest) with conversion of forest use for other purposes according to the template;

- The limit on forest allocation for households, individuals, and residential communities in accordance with land allocation limits;

- Evaluate the effectiveness of the forest allocation plan, forest lease, and conversion of forest use for other purposes on the socio-economy, environment, national defense, security; revenue from forest allocation, forest lease, and conversion of forest use for other purposes; job creation, labor attraction, poverty reduction; reasonable exploitation capability of forest resources; requirements for conservation, forest area development, and coverage rate associated with the preservation of scenic spots, ethnic culture, and factors affecting national defense and security;

- Identify resources (financial, labor, and technical), solutions, and implementation progress of forest allocation plans, forest leasing, and conversion of forest use for other purposes.

Decree 91/2024/ND-CP comes into effect in Vietnam from July 18, 2024, and replaces Decree 83/2020/ND-CP.
