Amendments to Circulars on toll booths and road use service price levels in Vietnam

In order to be consistent with the organizational structure specified in Decree 56/2022/ND-CP, Circular 07/2023/TT-BGTVT amends previously issued Circulars by changing the phrase "Directorate for Roads of Vietnam" with the phrase "Vietnam Road Administration".

Specifically, the Circulars being amended in Circular 07/2023/TT-BGTVT are as follows:

- Circular 35/2016/TT-BGTVT prescribing the ceiling road use service price levels to be applied by investment projects on road construction for commercial operation under the management by the Ministry of Transport.

- Circular 28/2021/TT-BGTVT amending Circular 35/2016/TT-BGTVT prescribing the ceiling road use service price levels to be applied by investment projects on road construction for commercial operation under the management by the Ministry of Transport.

- Circular 45/2021/TT-BGTVT  on operation of toll booths.

Criteria for establishment of a toll booth in Vietnam

According to Clause 1, Article 4 of Circular 45/2021/TT-BGTVT, criteria for the establishment of a toll booth:

(i) Must be situated within the range of the project (this does not applies with the collection method prescribed in Point a Clause 1 Article 9 of Circular 45/2021/TT-BGTVT).

(ii) Must be approved by competent authorities in the study report on the feasibility of the investment project or the project on the utilization of assets and infrastructure of road traffic.

(iii) Perform ETC methods and use modern and advanced technology to collect road tolls; in case of applying other methods, must be licensed by competent authorities.

(iv) Ensure the effective investment of the public-private project in case the toll booth provide capital recovery for the project.

(v) Publicize the location of the toll booth on central and local mass means of communications and at the People’s Committee of the commune or district where the toll booth is placed from the date of approval by competent authorities as per regulation prescribed in (i)
