Amendments to cases of driver license revocation in Vietnam from June 1, 2024

Circular 05/2024/TT-BGTVT amends and supplements the cases of driver license revocation as follows:

- The driver engages in deceitful conduct to obtain a driver license;

- The driver alters, erases, or falsifies information on the driver license;

- The driver allows another person to use their driver license;

- The competent authority issues a license to an ineligible person;

- There are errors in any information regarding the driver's name, date of birth, nationality, place of residence, license class, issuance value, test date, or the signatory;

- Through a health examination, the competent authority determines that the driver has drugs in their system (except for actions handled according to the provisions at point c and point d clause 10 Article 5; point h and point i clause 8 Article 6 of Decree 100/2019/ND-CP).

Procedure for driver license revocation in Vietnam:

The competent authority responsible for issuing driver licenses shall carry out the revocation process as follows:

- The head of the competent authority for issuing driver licenses issues a decision to revoke and cancel the driver license. The decision must clearly state the reason for the revocation and cancellation;

- Within 05 working days from the date of receipt of the revocation decision, the driver must submit the revoked driver license to the revoking authority. The competent authority responsible for issuing the driver license is responsible for retrieving and canceling the issued license according to regulations;

- In case the competent authority responsible for issuing driver licenses has been merged, divided, separated, or dissolved, the authority tasked with revoking and canceling the driver license is the agency currently managing the original issuance records.
