The Minister of Information and Communications issued Circular 23/2023/TT-BTTTT dated December 31, 2023 amending Circular 01/2020/TT-BTTTT guiding Publishing Law and Decree 195/2013/ND-CP, in which there are amendments to application for import of publications for business in Vietnam.
An application for import of publications for business includes:
- An application form for import of publications, using Form No. 26;
- 03 copies of list of publications registered for import if submitted in person or by post; 01 file of list of publications registered for import if submitted via the Vietnam National Single Window.
(Currently, according to Circular 01/2020/TT-BTTTT, an application for import of publications for business includes:
- An application form for import of publications;
- Three (03) copies of the list of publications registered for import).
In addition, according to Circular 23/2023/TT-BTTTT, the application for import of publications for business shall be submitted in person, by post service or via the Vietnam National Single Window under guidelines to the Authority of Publication, Printing and Distribution.
(Currently, according to Circular 01/2020/TT-BTTTT, the application for import of publications for business shall be submitted in person, by post or via the Vietnam National Single Window under guidelines to the Authority of Publication, Printing and Distribution.
In case there is a change in information in the list of publications registered for import whose registration has been confirmed, the business establishment importing publications must have a written report on the content of the changed information and, at the same time, register new information (if any) with the Authority of Publication, Printing, and Distribution to confirm additional registration.
Circular 23/2023/TT-BTTTT takes effect on May 1, 2024. If the application has to be submitted before May 1, 2024 but has not yet been completely processed, the agency, organization and individual related to the application shall continue to process it according to regulations in Circular 01/2020/TT-BTTTT until the application is completely processed.
According to Article 39 of the Publishing Law 2012, the registration of publication import for business is regulated as follows:
- The publication import for business shall be done by the importer of publications.
- Before importing, the importer of publications shall prepare dossier of import registration and send it to the Ministry of Information and Communications and pay the fee as prescribed by law. The Minister of Information and Communications shall detail the dossier for registration of publication import.
- Within 15 days from the date of receipt of dossier for registration of publication import, the Ministry of Information and Communications shall confirm the registration in writing. In the absence of registration confirmation, there must be written reply clearly stating the reasonss.
- Where there is a change of information in the dossier for registration of publicatio imported publications which have been confirmed for, the importer of publications must have written report on the content of the changed information, and register new information (if any) with the Ministry of information and Communications to confirm additional registration.
- The written confirmation of registration of the Ministry of Information and Communications is a legal foundation for the importer of publications to make importing procedures with the customs authorities and is valid until completion of the importing procedures.
6. In case of detection of contents of imported publications with violating signs of Vietnamese law, the Ministry of Information and Communications has the right to refuse confirmation of registration for publication import or request assessment of content of those publications before the confirmation of importing registration.
