The Amnesty Law 2018 was promulgated on November 19, 2018. One of the notable contents of this Law is the amendment and supplementation of the cases in which amnesty cannot be proposed.
To be specific: supplement the cases that are not eligible to request amnesty for the part of the judgment or court decision for those who are currently under protest according to the cassation or reopening procedure in the direction of increasing criminal liability.
In case of cassation or reopening that is in the direction of mitigating or maintaining criminal liability, the right to request amnesty remains.
At the same time, the Law on Amnesty 2018 also added the case of those who are sentenced to imprisonment for crimes such as: Treason; activities aimed at overthrowing the people's government; espionage; infringing upon territorial security; rebellion; terrorism aimed at opposing the people's government; etc.
