Amendment to the regulations on the use of basic geological investigation information on minerals, exploration, and mineral exploitation in Vietnam

The Government of Vietnam issued Decree 10/2025/ND-CP on January 11, 2025, amending the Decree in the field of minerals.

Amendment to the regulations on the use of basic geological investigation information on minerals, exploration, and mineral exploitation in Vietnam

Decree 10/2025/ND-CP has amended and supplemented Article 4 of Decree 158/2016/ND-CP regarding the use of basic geological survey information on minerals, exploration, and mining in Vietnam as follows:

- Organizations and individuals are entitled to use information on minerals that they have invested in, or mineral information owned by the State, or other organizations and individuals who have had their costs reimbursed according to Article 3 of Decree 158/2016/ND-CP (as amended by Decree 10/2025/ND-CP) and have the right to transfer and inherit according to the provisions of law.

- Organizations and individuals conducting mineral exploration with state budget funds are not allowed to provide or transfer information regarding the results of mineral exploration to other organizations or individuals, except when providing to competent authorities as regulated by the Ministry of Natural Resources and Environment.

- Six months from the date the mineral reserves are approved by the competent authority and the exploration license has expired, if the organization or individual permitted to explore does not submit an application for a mining license, the competent state management agency has the right to provide information about minerals in that area to other organizations and individuals for filing an application for a mining license, except in cases of force majeure.

Organizations and individuals using mineral exploration information are responsible for reimbursing exploration costs to the organizations and individuals who previously invested in exploration according to legal regulations.
