Amendment to the Regulations on conditions for issuing permits for the use of foreign digital certificates in Vietnam

Clause 2, Article 1 of Decree 48/2024/ND-CP amends Point b, Clause 1, Article 46 of Decree 130/2018/ND-CP on one of the following documents or electronic identification accounts, which is required to authenticate the information on foreign digital certificates in Vietnam. To be specific:

- Business registration certificate, investment certificate, establishment decision, decision stipulating functions, duties, and powers for organizations; identity card, citizen identification card, passport for individuals;

- Level 2 electronic identification account for individuals; electronic identification account of the organization for organizations;

- Document from a competent authority permitting foreign organizations and individuals to operate legally in Vietnam for subscribers who are foreign organizations or individuals;

- In cases of authorized use of digital certificates, there must be legal authorization for the use of the digital certificate, and the subscriber information provided in the digital certificate must match the information in the authorization document.

(Meanwhile, Point b, Clause 1, Article 46 of Decree 130/2018/ND-CP stipulates one of the following documents to authenticate the information on foreign digital certificates in Vietnam, including:

- Business registration certificate or investment certificate or establishment decision or decision stipulating functions, duties, and powers for organizations; identity card or citizen identification card or passport for individuals;

- Document from a competent authority permitting foreign organizations and individuals to operate legally in Vietnam for subscribers who are foreign organizations or individuals;

- In cases of authorized use of digital certificates, there must be legal authorization for the use of the digital certificate, and the subscriber information provided in the digital certificate must match the information in the authorization document.)

Refer to Decree 48/2024/ND-CP which comes into effect on May 9, 2024.
