Circular 62/2024/TT-BGTVT amending Circular 12/2022/TT-BGTVT on the list of products and goods potentially causing safety hazards under the State management responsibility of the Ministry of Transport of Vietnam was issued on December 30, 2024.
The principles for managing the list of products and goods with potential safety risks under the state management responsibility of the Ministry of Transport of Vietnam are as follows:
(1) The list of products and goods stipulated in Appendix I issued together with Circular 12/2022/TT-BGTVT apply the following principles:
- For imported products and goods, they must be certified for technical safety and environmental protection quality in accordance with regulations before customs clearance;
- For domestically produced and assembled products and goods, they must be certified for technical safety and environmental protection quality in accordance with regulations before being brought to the market.
(2) The list of products and goods stipulated in Appendix II issued together with Circular 12/2022/TT-BGTVT apply the following principles:
- Imported products and goods must be certified for technical safety and environmental protection quality in accordance with regulations after customs clearance and before being brought to the market;
- Domestically produced and assembled products and goods must be certified for technical safety and environmental protection quality in accordance with regulations before being brought to the market.
(Currently, Circular 12/2022/TT-BGTVT stipulates that the list of products and goods in Appendix II issued together with this Circular applies the following principles:
- Imported products and goods must be certified for technical safety and environmental protection quality according to regulations, except as stipulated in point b of this clause;
- Imported products and goods outlined in Section E of Appendix II issued together with this Circular for replacement and warranty purposes in quantities less than 100 products, goods of the same type in a batch can be declared in conformity based on the results of self-assessment of conformity or certified for technical safety and environmental protection as required by the organization or individual;
- The timing of certification or declaration of conformity at points a and b of this clause is conducted after the imported products and goods have cleared customs and before being brought to the market;
- Domestically produced and assembled products and goods must be certified for technical safety and environmental protection quality in accordance with regulations before being brought to the market).
Simultaneously, the following content is abolished: "The Vietnam Register shall receive the conformity declaration dossiers for products and goods in accordance with the law."
Circular 62/2024/TT-BGTVT shall take effect from February 15, 2025.
