Amendment to regulations on fees under the jurisdiction of the Provincial People's Council of Vietnam

On November 26, 2021, the Ministry of Finance of Vietnam promulgated Circular 106/2021/TT-BTC amend Circular 85/2019/TT-BTC on fees and charges under the jurisdiction of the provincial People's Councils ​​directly under the Central Government.

According to that, the new Circular has an adjustment on the authority to decide on a number of fees and charges:

- Fees for appraisal of detailed environmental protection schemes and projects for discharge of wastewater into water sources and irrigation works are no longer on the list of fees under the jurisdiction of the provincial People's Councils.

- Clearly stipulate the fee for appraisal of documents related to land use rights at point i, clause 1, Article 5 of Circular 85/2019/TT-BTC, including the case of first and new issuance of certificates (currently, the only general rule is to “grant” the certificate).

- Modifying the basis of collection for residence registration fee at Point a, Clause 2, Article 5, only the urban districts or wards of the city will have a higher fee rate than other areas.

In addition, the Residence Law of Vietnam amendment to residence fees such as the fee for adjusting information about residence in the Residency Database of Vietnam; fee for confirmation of residency information; and at the same time remove the fee for adjusting changes in the household registration book.
