This content is specified in the Circular 03/2022/TT-BNNPTNT amending to the Circular 05/2018/TT-BNNPTNT guiding on Irrigation Law issued by the Minister of Agriculture and Rural Development of Vietnam.
According to this Circular, amendments and supplements to some regulations on marking the boundary of irrigation projects for security purposes in Vietnam as follows:
- In case the works in Vietnam already have landmarks for ground clearance or landmarks for water protection corridors or landmarks of other works, these landmarks shall be considered as reference landmarks to determine only the scope of protection of the works. (Additional in case the works have landmarks for site clearance)
- Pursuant to the requirements of the management and protection of works, the provincial-level People's Committee shall decide on the case of setting up landmarks to limit the scope of protection of works in the area for submerged canals and cases not yet regulated.
(Compared to the current regulations, in particular, it is necessary to install landmarks to limit the scope of protection of works in the area for submerged channels, instead of other irrigation works in Vietnam).
- Additional regulations: The budget estimate for setting up landmarks, except for new construction and repair works, shall be decided by the Ministry of Agriculture and Rural Development of Vietnam to approve the investment policy.
Circular 03/2022 /TT-BNNPTNT takes effect from August 1, 2022 .
