Amended guidelines on management of environmental protection funding in Vietnam

The Minister of Finance of Vietnam promulgates Circular 94/2024/TT-BTC dated December 31, 2024, amending Circular 02/2017/TT-BTC, which provides guidelines on management of environmental protection funding.

The expenditure level for environmental protection activities in Appendix 1 attached to Circular 02/2017/TT-BTC is the maximum expenditure level. Based on the actual situation and the local budget capability, the Provincial People's Committee will submit to the Provincial People's Council for decision the specific expenditure level to be implemented locally.

(Currently, according to Clause 2, Article 5 of Circular 02/2017/TT-BTC, the expenditure level prescribed in Appendix 01 attached to Circular 02/2017/TT-BTC is the maximum expenditure level, based on the actual situation and local budget capability, the Provincial People's Committee stipulates the specific expenditure level to be implemented locally.)

Circular 94/2024/TT-BTC takes effect from February 15, 2025.

Funds for implementing environmental protection expenditure tasks in Vietnam

According to Circular 02/2017/TT-BTC, the funds for carrying out environmental protection expenditure tasks include:

  1. State budget funds

- The central budget (including domestic sources and foreign sources) ensures costs for implementing environmental protection tasks carried out by the Ministries and central agencies;

- The local budget ensures costs for environmental protection tasks carried out by local agencies and units according to decentralization;

- The Ministry of Finance coordinates with the Ministry of Planning and Investment, the Ministry of Natural Resources and Environment, and the Provincial People's Committee to present to the competent authority to allocate environmental protection operating funds no less than 1% of the total state budget expenditure in the annual budget estimate.

  1. Other sources as prescribed by law (if any).

  2. For projects and proposals on environmental protection to be eligible for funding and implementation, they must be approved by a competent authority.

  3. Agencies, units, and individuals utilizing environmental protection operating funds must adhere to the contents approved by competent authorities; manage and use the funds in accordance with policies, economically and effectively; and are subject to inspection and control by competent functional agencies. They must carry out settlement, and make budget policies public in accordance with current regulations.
