The Government of Vietnam promulgated Decree 123/2024/ND-CP on October 4, 2024, stipulating land-related administrative sanctions in Vietnam.

Administrative sanctions for violations against regulations on documents, certificates in land use in Vietnam are as follows:

- A fine ranging from 2,000,000 VND to 5,000,000 VND will be imposed for altering, amending, or falsifying the content of documents, papers in land use which are not specified in Clause 2 and Clause 3, Article 27 of Decree 123/2024/ND-CP.

- A fine ranging from 5,000,000 VND to 10,000,000 VND will be imposed for dishonestly reporting land use, or altering, amending, or falsifying the content of documents, papers in land use that lead to incorrect issuance of Certificates and mislead in conversions, transfers, leases, inheritances, gifts, mortgages, contributions of capital by land use rights, which do not reach the level of criminal liability.

- A fine ranging from 10,000,000 VND to 20,000,000 VND will be imposed for using fake documents in performing administrative procedures and other works related to land which do not reach the level of criminal liability.

- Additional sanctions: Confiscation of the altered, amended documents that have falsified content; confiscation of fake documents used.

- Measures to remedy consequences: Cancellation of administrative procedure outcomes related to land that have been carried out according to the provisions for the case mentioned in Clause 3, Article 27 of Decree 123/2024/ND-CP.

More details can be found in Decree 123/2024/ND-CP, which takes effect in Vietnam from October 4, 2024.

Decree 91/2019/ND-CP on land-related administrative sanctions in Vietnam; Article 1 of Decree 04/2022/ND-CP on amendments and supplements to several articles of the decrees on land-related administrative sanctions in Vietnam; water resources and minerals; meteorology and hydrology; surveying and mapping will cease to be effective from the effective date of Decree 123/2024/ND-CP.
