The Vietnamese government has promulgated Resolution 126/NQ-CP amend Resolution 68/NQ-CP 2021 on a number of policies to support employees and employers facing difficulties due to the COVID-19 pandemic.
According to the Resolution, additional provisions on the case where the employee who is suspended from work is supported:
An employee working under a labor contract is terminated for reasons specified in Clause 3, Article 99 of the Labor Code of Vietnam; are participating in compulsory social insurance up to the time immediately before stopping work and in one of the following cases:
- Having to be treated for Covid-19, medical isolation, in blocked areas or unable to go to the workplace due to the request of state agencies according to the principles of Directive 16/CT-TTg of Vietnam;
- Because the employer has to suspend operations at the request of a competent authority or has its head office, branch, representative office, etc. in the area to take measures to prevent and control the epidemic according to the principles of the Directive 16/CT-TTg or rearrange production and labor for epidemic prevention and control:
From 14 consecutive days or more from May 1, 2021 to the end of December 31, 2021.
(Resolution 68 only stipulates that it applies to those subject to medical isolation or in locked-down areas at the request of competent authorities for 14 days or more from May 1, 2021 to the end of December 31, 2021.
Resolution 126/NQ-CP of Vietnam takes effect from October 8, 2021.
