On August 23, 2021, the Ministry of National Defense of Vietnam issued Circular 109/2021/TT-BQP amending Circular 113/2016/TT-BQP stipulating the leave regime of professional soldiers, workers and defense officers.
According to Vietnam's Circular 109/2021/TT-BQP, additional regulations on retirement preparation for professional soldiers are as follows:
- Professional soldiers, workers, and defense officers who have decided to retire are entitled to retirement preparation (taking a break to prepare their family rear) as follows:
+ From full 20 years to less than 25 years of working, 9 months of leave;
+ From full 25 years of work or more, 12 months of leave.
- Professional military personnel, workers and defense officers who are eligible for retirement, if they do not wish to take the leave to prepare for retirement (with immediate pension), or do not have enough time to arrange it: When they retire, they shall be entitled to the difference between the salary of the last month before receiving a pension and the first month's pension for the number of months without retirement. - Professional soldiers, workers, and defense officers who are on leave to prepare to retire at home must register their leave time with the People's Committees of communes, wards, and townships in accordance with Vietnam's Law on Residence. (New content)
- During the period of retirement, if suffering from a serious illness, a disease requiring long-term treatment, or a mental illness, the current regulations in Vietnam's Circular 157/2013/TT-BQP shall be applied.
Vietnam's Circular 109/2021/TT-BQP takes effect from October 10, 2021.
