On November 11, 2023, the Minister of National Defense of Vietnam issued Circular 83/2023/TT-BQP amending a number of articles of circulars under the promulgation authority of the Minister of National Defense.
Add one more method for handling state assets; Additional methods of handling state assets include:
(1) Guns and artillery: Commanders of military zones direct units under their authority to organize the recovery to warehouses and workshops of the military zone; the remaining agencies and units report to the Chief of the General Staff to issue a decision to recall to the Ministry of National Defense warehouse:
- Organizing installation, repair, and restoration; disassembling and utilizing spare parts and replacement parts for repairs;
- Utilizing as a learning tool model; serving training, museum displays, and military and national defense tasks;
- For infantry guns that are no longer in their original form and whose separate parts are no longer usable for disassembly, assembly, repair, or restoration, the unit reports to the Minister of National Defense for consideration and decision on removal from the payroll and handling;
- For other types, units are assigned to store and closely manage them until there is a decision from the Minister of National Defense.
(2) Ammunition and toxic chemicals:
Process (destroy, disassemble) according to methods consistent with industry regulations and treatment technology processes issued by competent authorities, ensuring absolute safety.
(3) Items recovered after ammunition processing:
- Number of items that are still in good condition and can be reused or recalled for centralized storage and preservation at the Ministry of National Defense warehouse or warehouse used for repair and production according to mission requirements;
- Artillery shells and copper materials recovered after processing ammunition that are damaged and no longer capable of repair or restoration may only be processed after receiving a written opinion from the Minister of National Defense;
- Items, raw materials, and scrap recovered after treatment cannot be utilized for repair, ammunition production, or use as model learning tools for training, or has deformed or completely disabled the fire and explosion properties and the ability to restore the original shape for recycling for production; organize a public auction for factories in the Army that have smelting technology to smelt raw materials to serve national defense tasks;
- Explosive materials obtained from dismantling and dismantling ammunition can only be sold at public auction to units and factories in the Army that have the function of recycling and producing industrial explosives;
- Do not sell items or scrap recovered after ammunition processing outside the Army.
(4) Assets are technical equipment, supplies, and goods:
- Absolutely safe destruction of information technology equipment and media containing information and toxic chemicals;
- Disassemble usable parts and spare parts (over 50% quality of new parts and spare parts) to serve technical assurance work;
- Utilize as models of learning tools, training services, display artifacts and military and defense tasks;
- The remaining amount, after disabling military features, will be held in public auction for units with legal status inside and outside the Army.
(5) Materials and items recovered in the process of demolishing and destroying assets such as combat works, defense works, houses, and assets attached to land will be sold at a public auction in accordance with current law.
(6) For drugs subject to special control in the Army, handle them according to the law on pharmacy and the instructions of the Military Medicine sector.
(7) Special assets can only be sold for separate parts that cannot be salvaged, used for repairs, technical assurance, and items recovered after processing in the form of a public auction for factories and defense industry production units in the Army; they are not sold to units outside the Army (new regulations)
(8) Cases that do not fall under the above methods are decided by the Minister of National Defense.
