On June 11, 2021, the Ministry of Finance of Vietnam issued Circular 43/2021/TT-BTC amendingCircular 219/2013/TT-BTC stipulating guidelines the Law on VAT.
Specifically, this circular adds a number of medical equipment that are subject to the VAT rate of 5% compared to the previous one, specifically:
- Medical equipment requiring import permit, circulation registration certificate or notice on receipt of standard declaration according to regulations and law on medical or according to list of medical equipment under specialized management of Minister of Health with commodity code identified according to list of Vietnamese import and export commodities attached to Circular 14/2018/TT-BYT dated May 15, 2018 of Minister of Health of Vietnam and amending documents (if any).
- Chemicals for experiment and sterilization in medical.
Currently, medical equipment that is subject to the 5% tax rate include:
- Medical equipment include radiographic equipment, equipment and instruments for surgery and treatment;
- Instruments for blood pressure measurement, cardiography, blood infusion,
- Syringes;
- Birth control equipment, and other medical equipment certified by the Ministry of Health of Vietnam;
- Cotton wool, bandages, gauze pads, and medical tampons;
- Medicines including finished medicines and raw materials, except for functional foods; vaccines;
- Bioproducts, distilled water to mix with injectable medicines or intravenous fluids; chemicals used for testing and sterilization; caps, clothing, facemasks, gloves, boots, medical towels, breast implants and skin fillers;
- Chemicals for experiment and sterilization in medical certified by the Ministry of Health of Vietnam.
Circular 43/2021/TT-BTC takes effect from August 1, 2021
