Additional chemicals, pesticide products, disinfectants or sanitizers used in household appliance and health care industry for which the certificate of approval for advertisement contents have been issued

ircular 20/2024/TT-BYT has added point c after point b, clause 2, Article 12 of Circular 09/2015/TT-BYT, according to which the Health Departments of provinces and centrally affiliated cities grant certificate of approval for advertisement contents for:

Chemicals, pesticide products, disinfectants or sanitizers used in household appliance and health care industry by the entity requesting certificate of approval for advertisement contents, which has its headquarters located within the management area of the Health Department.

Additionally, Circular 20/2024/TT-BYT has also stipulated transitional provisions as follows:

(1) Organizations and individuals that have been granted certificate of approval for advertisement contents for chemicals, pesticide products, disinfectants or sanitizers used in household appliance and health care industry before the date Circular 20/2024/TT-BYT takes effect (November 28, 2024) shall continue to advertise in accordance with the regulations.

(2) Organizations and individuals that have submitted documents requesting the grant of certificate of approval for advertisement contents for chemicals, pesticide products, disinfectants or sanitizers used in household appliance and health care industry before this Circular takes effect shall comply with the regulations under Circular 09/2015/TT-BYT.

(3) The re-issuance of certificate of approval for advertisement contents for chemicals, pesticide products, disinfectants or sanitizers used in household appliance and health care industry granted by the Department of Environmental Health of the Ministry of Health of Vietnam before the date Circular 20/2024/TT-BYT takes effect shall be carried out as follows:

- In the case of re-issuing certificate of approval for advertisement contents for chemicals, pesticide products, disinfectants or sanitizers used in household appliance and health care industry due to loss or damage as regulated in clause 1, Article 21 of Circular 09/2015/TT-BYT, the entity named on the certificate of approval for advertisement contents or the authorized entity shall implement re-issuance at the Department of Environmental Health - Ministry of Health of Vietnam;

- In the case of re-issuing certificate of approval for advertisement contents for chemicals, pesticide products, disinfectants or sanitizers used in household appliance and health care industry as set out in clauses 2, 3, and 4, Article 21 of Circular 09/2015/TT-BYT, the entity named on the certificate of approval for advertisement contents or the authorized entity shall carry out re-issuance at the Health Department of the province or centrally affiliated city where the headquarters of the entity named on the certificate of approval for advertisement contents is located;

- The procedure for re-issuing certificate of approval for advertisement contents for chemicals, pesticide products, disinfectants or sanitizers used in household appliance and health care industry shall be carried out in accordance with the regulations of Article 21 of Circular 09/2015/TT-BYT.
