On November 27, 2024, the National Assembly adopted the Law on Trade Union of 2024. This Law provides additional regulations on cases of exemption, reduction, or suspension of payment of union dues.

Addition of cases of exemption, reduction, or suspension of payment of union dues

To be specific, the exemption, reduction, or suspension of payment of union dues is specified in Article 30 of the Law on Trade Union of 2024 as follows:

- Enterprises, cooperatives and cooperative unions that dissolve or go bankrupt in accordance with the law will be considered for exemption of the unpaid union dues.

- Enterprises, cooperatives and cooperative unions that encounter difficulties due to financial issues or force majeure will be considered for a reduction in union dues.

- In case an enterprise, cooperative or cooperative union encounters difficulties and has to temporarily stop production and business, resulting in the inability to pay union dues, it will be considered to suspend payment of union dues within 12 months.

When the deadline expires, the enterprise, cooperative or cooperative union shall proceed with the payment of its union dues and pay the outstanding union dues for the period of payment suspension. The deadline for payment of the outstanding union dues is the last day of the month following the month in which the payment suspension ends. The amount payable is equal to the outstanding union dues for months of payment suspension.

- The Government reaches an agreement with the Vietnam General Confederation of Labour on the exemption, reduction, or suspension of payment of union dues; and elaborates on other contents of this Article. 

It is known that the Law on Trade Union of 2024 regulates functions, tasks, powers and responsibilities of the Vietnam Trade Union; employees' rights to establish, join and operate trade unions; the participation in the Vietnam Trade Union of employees' organizations at enterprises; rights and responsibilities of trade union members; responsibilities of the State, agencies, organizations, units, enterprises, and employers towards the Trade Union; assurance of the activities of the Trade Union; resolution of disputes and handling of violations of trade union laws.

For more details, see the Law on Trade Union of 2024 which comes into force from July 01, 2025 and replaces the Law on Trade Union of 2012.
