Abolition of certain regulations on goods and services prohibited from trading, restricted from trading in Vietnam from January 15, 2025

On December 27, 2024, the Government of Vietnam issued Decree 173/2024/ND-CP to partially repeal Decree 59/2006/ND-CP which provides guidance on the Commercial Law concerning prohibited business goods and services, restricted business, and conditional business; and to repeal Decree 43/2009/ND-CP, which amended the List of prohibited business goods and services under Decree 59/2006/ND-CP, guiding the implementation of the Commercial Law concerning prohibited business goods and services, restricted business, and conditional business.

Abolition of certain regulations on goods and services prohibited from trading, restricted from trading in Vietnam from January 15, 2025

A partial repeal of Decree 59/2006/ND-CP and a complete repeal of Decree 43/2009/ND-CP are outlined as follows:

- Complete repeal of Decree 43/2009/ND-CP revising and supplementing the list of prohibited goods and services of Decree 59/2006/ND-CP.

- Partial repeal of Decree 59/2006/ND-CP as follows:

+ Repeal Point b, Point c Clause 1 of Article 4, and Articles 6, 7, 8.

+ Repeal Points 1 through 12, Point 14, Point 17, and Point 18 in Section A concerning Goods and the entirety of Section B concerning Services of Appendix I on the list of prohibited goods and services.

+ Repeal Appendix II on the list of goods and services subject to restricted trade, and Appendix III on the list of goods and services subject to conditional trade.

Detailed contents can be reviewed in Decree 173/2024/ND-CP which becomes effective from February 15, 2025.

The Ministry of Natural Resources and Environment of Vietnam is to issue or propose to the competent authority to issue a legal document managing particularly hazardous minerals by June 30, 2027.

The Ministry of Health of Vietnam is to issue or propose to the competent authority to issue legal documents managing medicines for human use, vaccines, medical biological products, cosmetics, chemicals, and preparations for insect and germ control in the fields of household and health use which are not yet permitted for use in Vietnam, and medical equipment not yet authorized for use in Vietnam by June 30, 2027.
