Abolishment of the Joint Circular on environmental protection fees for wastewater in Vietnam as of December 30, 2024 is the content issued by the Minister of Finance of Vietnam in Circular 79/2024/TT-BTC dated November 11, 2024, abolishing the Joint Circulars of the Minister of Finance, Minister of Natural Resources and Environment.

Abolishment of the Joint Circular on environmental protection fees for wastewater in Vietnam from December 30, 2024

The following 02 Joint Circulars are entirely abolished:

- The Joint Circular 135/2008/TTLT-BTC-BTNMT of the Ministry of Finance and the Ministry of Natural Resources and Environment guiding methods to determine the value, methods, and procedures for payment for the use of data and information on the results of State-conducted mineral investigations and explorations.

- The Joint Circular 63/2013/TTLT-BTC-BTNMT of the Minister of Finance and the Minister of Natural Resources and Environment guiding the implementation of Decree 25/2013/ND-CP regarding environmental protection fees for wastewater.

Subjects subject to environmental protection fees for wastewater in Vietnam under Joint Circular 63/2013

According to Joint Circular 63/2013/TTLT-BTC-BTNMT, the subjects liable for environmental protection fees for wastewater include wastewater discharged into the environment, comprising industrial wastewater and domestic wastewater include:

- Industrial wastewater is wastewater discharged into the environment from:

+ Production and processing facilities for agricultural products, forestry products, and seafood;

+ Production and processing facilities for food, alcohol, beer, beverages, and tobacco;

+ Livestock and slaughter facilities for concentrated cattle and poultry;

+ Aquaculture farms;

+ Handicraft production facilities in craft villages;

+ Tanning and leather recycling facilities;

+ Mining and mineral processing facilities;

+ Textile, dyeing, and garment production facilities;

+ Paper, pulp, plastic, and rubber production facilities;

+ Fertilizer, chemical, pharmaceutical, pesticide, construction material, stationery, and household goods production facilities;

+ Mechanical, metallurgy, metal processing, machinery, and parts manufacturing facilities;

+ Component, electrical, and electronic equipment manufacturing facilities;

+ Facilities for preliminary waste processing, dismantling old ships, and ship cleaning;

+ Clean water plants;

+ Centralized wastewater treatment systems in industrial zones and urban areas (except cases exempted from environmental protection fees under the law);

+ Other industrial production facilities.

- Domestic wastewater is wastewater discharged into the environment from:

+ Households;

+ Government agencies;

+ People's armed forces units (except production and processing facilities of the people's armed forces units);

+ Headquarters, branches, and offices of organizations and individuals not associated with production and processing locations;

+ Facilities for car washing, motorbike washing, car repair, motorbike repair;

+ Hospitals; medical examination and treatment clinics; restaurants, hotels; educational and research institutions; other business and service facilities;

+ Other organizations, individuals, and subjects with wastewater not stipulated in Clause 1, Article 1 of Joint Circular 63/2013/TTLT-BTC-BTNMT.

Circular 79/2024/TT-BTC takes effect on December 30, 2024.
