16 New Decrees Effective from July 01, 2018 (Final Part)

The Legal Secretary continues to introduce to our esteemed members the final 04 Decrees related to areas such as Transportation; Agriculture, rural development, and Science and technology.

  1. Preferential Interest Loans for Enterprises Receiving Technology Transfer

This notable content is stipulated in Decree 76/2018/ND-CP providing guidance on the implementation of certain articles of the Law on Technology Transfer.

Loans with preferential interest rates and interest rate support shall be provided to enterprises with projects in preferential investment sectors or areas receiving technology transfer.

The support levels for enterprises are specified as follows:

- The support level follows current regulations for the sources stipulated in point a, clause 4, Article 8;- A maximum of 2% per annum interest rate support from the National Technology Innovation Fund, the science and technology development funds of ministries, ministerial agencies, agencies under the Government of Vietnam, provinces, centrally-run cities on loans for technology transfer in projects;- Loans with preferential interest rates according to the regulations of funds, credit organizations providing preferential loans for technology transfer in projects.

  1. Regimes and Policies for Security Personnel on Ironclad Ships

On May 15, 2018, the Government of Vietnam issued Decree 75/2018/ND-CP specifying the organization, duties, powers, uniforms, insignia, and emblem of the security force on ships.

Notable are the policies and policies for the security force on ironclad ships. Specifically:

- Receive training and professional education in security and technical fields related to their current tasks;- Be equipped with supportive tools as provided by law and other necessary equipment, uniforms, insignia, badges, ranks, and nameplates to perform assigned tasks;- While performing their duties, if injured or sacrificed, they shall be considered and may be recognized to receive policies like wounded soldiers or martyrs according to the law on preferential treatment for people with meritorious services to the revolutionary cause, and other forms of commendation provided by law on emulation and commendation.

More details can be found in Decree 75/2018/ND-CP, effective from July 1, 2018.

  1. The Maximum Validity of Licences for Activities within Water Conservancy Works is 5 Years

Specifically, licenses for activities such as new construction, renovation, repair, etc., within the protection scope of water conservancy works will have a maximum validity of 5 years.

This license’s validity may be extended multiple times, each extension not exceeding 3 years. However, the validity may be changed or adjusted by the licensing authority if the water conservancy works fall under the following cases:

- The water conservancy works are at risk of loss of safety;- Activities within the protection scope affect the operation of the works;- The water conservancy works can no longer receive wastewater.

The aforementioned points are based on Decree 67/2018/ND-CP detailing some articles of the Law on Water Resources.

  1. Railway Fare Discount Rates for Social Policy Beneficiaries

In Decree 65/2018/ND-CP guiding the implementation of the Law on Railways, there are provisions regarding railway fare discount rates for social policy beneficiaries, specifically:

- A 90% fare discount for those who participated in revolutionary activities before the August 19, 1945 uprising; Heroic Vietnamese Mothers;- A 30% fare discount for war invalids, beneficiaries of policies like wounded soldiers; chemical warfare victims;- Fare discounts for persons with particularly severe disabilities; persons with severe disabilities; the elderly shall be implemented in accordance with the law on persons with disabilities and the elderly.
