On December 31, 2024, the Government of Vietnam issued Decree 177/2024/ND-CP stipulating policies concerning cases of non-reappointment, reappointment failure, and officials resigning or retiring voluntarily.
Policies for officials awaiting mandatory retirement age in Vietnam are specifically stipulated in Clause 2, Article 4 of Decree 177/2024/ND-CP, including:
- Enjoying the full position salary or salary according to rank, grade, position allowance, seniority allowance exceeding the framework, professional seniority allowance, preserved salary differential, and responsibility allowance for committee members at all levels (if any) until reaching retirement age;
- Individuals awaiting retirement age and their respective agencies shall continue to pay social insurance and health insurance premiums as prescribed by law;
- No salary rank, grade promotion during the period of awaiting retirement age. Other policies such as service benefits, phone allowances (if any), and allowances other than those specified in subsection a, Clause 2, Article 4 Decree 177/2024/ND-CP shall cease from the month immediately following the month of the decision to await retirement age. Other policies, if any, shall be implemented according to the regulations and rules of the agency, organization, or unit, as applicable to those who have retired;
- In cases where an individual awaiting retirement age is entitled to the regular use of a car while in service, the agency is responsible for arranging transportation if required for meetings, conferences, or medical appointments; if unable to arrange, compensation will be provided as per regulations;
- In cases where, after the policies for awaiting retirement age expire, the individual still lacks the mandatory number of years for social insurance contributions to receive a pension, a one-time financial support for the remaining duration (up to 30 months) will be provided into the retirement and survivorship fund based on the social insurance salary level at the month of attaining retirement age to ensure pension realization.
