05 Conditions for the establishment of a public service provider in Vietnam

Recently, the Government of Vietnam has issued Decree 120/2020/ND-CP stipulating the establishment, reorganization, and dissolution of public service providers in Vietnam.

Pursuant to Article 5 of Decree 120/2020/ND-CP, 05 conditions for establishing a public service provider are specified as follows:

- Consistent with the national sector planning or the network planning of public service providers (if any) that has been approved by the competent authority;

- Meeting all criteria for establishing a public service provider as stipulated by specialized laws;

- Clearly defining the objectives, functions, and tasks of the public service unit, serving state management;

- Ensuring a minimum working staff of 15 people;

- Having a working office or a land allocation project for constructing a new office that has been approved by the competent authority (in the case of constructing a new office); initial necessary equipment; human resources, and operational funding as per legal regulations.
