On November 12, 2019, the Government of Vietnam issued Decree No. 82/2019/NĐ-CP prescribing the import and breaking of used ships.
It is emphasized by Decree No. 82/2019/NĐ-CP of Vietnam’s Government that a ship-breaking facility is required to meet the following requirements:
- It must have wharfs and navigational channels published in accordance with Decree No. 58/2017/ND-CP dated May 10, 2017 of Vietnam’s Government on guidelines for some articles of the Vietnam Maritime Code on management of maritime operations.
- It must meet environmental protection requirements for ship-breaking facilities set forth in Decree No. 40/2019/ND-CP dated May 13, 2019 of Vietnam’s Government on amendments to Decrees on guidelines for the Law on Environment Protection.
- It must have personnel and procedures for control of hazards and harmful factors, and the plan for handling serious technical incidents threatening occupational safety and health in accordance with Decree No. 39/2016/ND-CP dated May 15, 2016 of Vietnam’s Government detailing the implementation of some articles of the Law on occupational safety and sanitation.
- It must meet fire prevention and control requirements and have a firefighting plan in accordance with Decree No. 79/2014/ND-CP dated July 31, 2014 of Vietnam’s Government on guidelines for the Law on Fire safety and firefighting and the Law on amendments to the Law on Fire safety and firefighting.
Notably, the Minister of Transport shall make decisions to put the ship-breaking facilities into operation at the request of the Director of Vietnam Maritime Administration.
