04 regulations on the forms of BOT contract in Vietnam's transport sector

The Minister of Transport of Vietnam issued Circular 09/2022/TT-BGTVT on guidelines of the forms of BOT contract in the transport sector.

In particular, there are 04 regulations on the forms of BOT contract in Vietnam's transport sector as follows:

- Regarding the agreement documents of the parties on the contract:

Agreement documents of the parties on the contract include:

+ Legal basis for signing the project contract;

+ General information about the parties signing the project contract (contract signing agency, investor, project enterprise);

+ Contract dossier and legal priority order;

+ Contract term and effective date of the contract.

- Regarding the general conditions of the contract: The general conditions of the contract include the general terms applied in BOT contracts in Vietnam's transportation sector.

- Regarding the specific conditions of the contract: The specific conditions of the contract clarify the contents corresponding to the general conditions of the BOT contract in Vietnam's transportation sector.

- About the contract appendix: The contract appendix is an integral part of the project contract. In case of necessity, the contract may have a contract appendix attached to detail a number of terms of the contract.

In Vietnam, Circular 09/2022/TT-BGTVT takes effect from October 1, 2022.
