04 new administrative procedures related to science and technology in Vietnam

There are 04 new administrative procedures related to science and technology in Vietnam under the Ministry of Science and Technology, including:

- Central-level administrative procedures:

+ Administrative procedure for determining whether an investment project uses outdated technology or poses potential risks of environmental pollution and resource depletion.

+ Administrative procedure for designating or re-designating organizations to inspect machinery, equipment, and technological lines in investment projects.

+ Administrative procedure for additional designation of machinery, equipment, and technological lines to be inspected in investment projects.

- Provincial-level administrative procedures:

Administrative procedure for determining whether an investment project uses outdated technology or poses potential risks of environmental pollution and resource depletion.

Administrative procedure for additional designation of machinery, equipment, and technological lines to be inspected in investment projects in Vietnam

- The appraisal organization shall prepare and submit one additional application for the scope of inspection activities of machinery, equipment, and technological lines in the investment project, directly or through the postal service, to the Single-Window Department of the Ministry of Science and Technology or submit it on the Ministry's administrative procedure settlement information system for registration.

- Within 03 working days from the date of receiving the application, if the application is incomplete or invalid according to regulations, the Ministry of Science and Technology shall notify the appraisal organization in writing to amend the application.

- Within 30 days from the date of receiving the complete and valid dossier, the Ministry of Science and Technology shall evaluate the actual capacity of the appraisal organization through the dispatch of experts or the establishment of evaluation teams. The content of the actual capacity evaluation shall comply with the regulations in Clause 4 of Article 7 of Decision 29/2023/QD-TTg. The evaluation results of the actual capacity at the appraisal organization must be notified in writing to the appraisal organization that has submitted the application at least 05 working days in advance.

In case the appraisal organization needs to rectify the contents specified in the actual capacity evaluation report, within 30 days, the appraisal organization must submit a report on the results of rectification actions to the Ministry of Science and Technology. If the contents requiring rectification need to be extended, the appraisal organization shall report to the Ministry of Science and Technology in writing, clearly stating the official deadline for completing the rectification of the mentioned contents.

- Within 10 working days from the date of receiving the report on the results of rectification actions according to the actual capacity evaluation report, if the appraisal organization has fully rectified all contents and met the requirements according to regulations, the Ministry of Science and Technology shall issue a decision designating the appraisal organization to carry out the appraisal of machinery, equipment, and technological lines in the investment project.

In case of refusal to designate, the Ministry of Science and Technology must notify the appraisal organization in writing of the reasons.
