On January 6, 2025, the Government of Vietnam issued Decree 05/2025/ND-CP amending Decree 08/2022/ND-CP, which provides guidance on the Law on Environmental Protection. This document outlines 03 forms of consultation in environmental impact assessments to be applied from January 6, 2025.

The 03 consultation forms for environmental impact assessment from January 6, 2025 in Vietnam include:
- Consultation through posting on an information portal;
- Consultation by organizing opinion-gathering meetings;
- Consultation in writing.
Regarding the consultation form through posting on an information portal:
Before submitting the environmental impact assessment report to the competent authority for appraisal, the project investor must send the project's environmental impact assessment report along with the consultation content, as per the form prescribed in Appendix VIa issued with Decree 08/2022/ND-CP, to the management unit of the information portal of the environmental impact assessment appraisal agency to consult with the subjects specified in Clause 1, Article 26 of Decree 08/2022/ND-CP (amended in Decree 05/2025/ND-CP), except for information classified as state secrets or business secrets under legal regulations.
Within 01 day from the receipt date of the posting request from the project investor, the management unit of the information portal of the appraisal agency is responsible for posting the consultation content. The consultation is carried out within 15 days for group I investment projects as specified in Appendix III, 10 days for group II investment projects as specified in Appendix IV issued with Decree 08/2022/ND-CP, and 05 days for projects located in concentrated production, business, and service areas, and industrial clusters.
Within 03 days from the end date of consultation, the management unit of the information portal is responsible for sending the consultation results to the project investor.
