03 additional administrative procedures for commune-level forces participating in security protection

On June 28, 2024, the Ministry of Public Security (Hanoi, Vietnam) issued Decision 4768/QD-BCA announcing new administrative procedures related to the forces participating in the protection of security and order at the grassroots level under the state management of the Ministry of Public Security (Hanoi, Vietnam).

To be specific:, in the newly issued administrative procedures related to the security and order protection forces at the grassroots level within the scope and functions of state management by the Ministry of Public Security (Hanoi, Vietnam), issued under Decision 4768/QD-BCA dated June 28, 2024, there are 3 additional administrative procedures for the security forces at the commune level, including:

- Selection of members for the Security and Order Protection Team

- Resolving policies for individuals participating in the security protection force at the grassroots level who do not have health insurance and are ill, injured, or in an accident while performing their duties

- Resolving policies for individuals participating in the security protection force at the grassroots level who do not have social insurance and are in an accident or die while performing their duties

The procedure for resolving policies for individuals participating in the security protection force at the grassroots level who do not have health insurance and are ill, injured, or in an accident while performing their duties is as follows:

- Step 1: The individual prepares a dossier according to the legal provisions.

- Step 2: Submit the dossier to the People’s Committee at the commune level or the People's Committee at the district level.

- Step 3: The People’s Committee at the commune or district level organizes the reception and inspection of the dossier. In case the dossier is not valid, there is a responsibility to provide immediate guidance for completion. Within 2 working days from the date of receipt of the valid dossier, the receiving agency forwards the dossier to the District Labor, War Invalids, and Social Affairs Office for appraisal.

- Step 4: The District Labor, War Invalids, and Social Affairs Office is responsible for appraising the dossier within 5 working days from the date of receipt of the valid dossier. If the dossier does not meet the conditions for resolution, the appraising agency must issue a written response stating the reasons.

- Step 5: Within 2 working days from the date the District Labor, War Invalids, and Social Affairs Office reports that the dossier meets the conditions for resolution, the Chairman of the District People’s Committee issues a decision to pay the medical expenses for the individuals who are ill, injured, or in an accident.

- Step 6: Within 3 working days from the date the Chairman of the District People’s Committee issues the decision to pay the expenses, the People’s Committee at the commune level is responsible for disbursing the medical expenses to the individuals who are ill, injured, or in an accident. In places without a commune-level administrative unit, the district police are responsible for the disbursement; payments can be made via bank transfer, postal service, or direct receipt at the disbursing agency.

More details can be found in Decision 4768/QD-BCA which comes into force in Vietnam from June 28, 2024.
